Our AI chatbot ("Ava") is powered by a third-party Large Language Model. You acknowledge that:
- Ava may produce inaccurate, incomplete, or outdated responses. Do not rely solely on chatbot responses for employment, legal, financial, or medical decisions.
- Switch4 does not guarantee the accuracy, completeness, or fitness of AI-generated content for any purpose.
- Conversations with Ava are transmitted to our secure backend and to an LLM provider for processing. Do not share highly sensitive personal information (e.g., Social Security numbers, passwords, financial account details) in chat.
- Switch4 is not liable for any loss or damage arising from reliance on chatbot responses.
4. Candidate Responsibilities
If you use our Services as a job seeker, you agree to:
- Provide accurate, truthful, and complete information in your profile and applications
- Promptly notify Switch4 of any changes to your availability, qualifications, or contact information
- Not misrepresent your skills, experience, qualifications, or work authorization status
- Maintain professional conduct with Switch4 staff and any employer contacts we facilitate
- Not use our Services for any unlawful purpose
5. Employer / Client Responsibilities
If you use our Services as an employer or hiring organization, you agree to:
- Provide accurate job descriptions and requirements
- Handle candidate information shared by Switch4 in compliance with applicable privacy laws
- Not discriminate against candidates on the basis of any protected characteristic
- Honor any agreements made regarding placement fees and terms
- Maintain confidentiality of candidate information

You may not use our Services to:
- Post fraudulent job listings or create fake employer profiles

Our total liability for any claim shall not exceed the greater of (a) the fees you paid to Switch4 in the three months prior to the claim, or (b) US $100.

13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware. You consent to personal jurisdiction in those courts.
For disputes involving amounts less than $10,000, either party may elect binding arbitration under the American Arbitration Association's rules.
14. Modifications
We may update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our Services after changes constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.
